Terms & Conditions of Trading

You can place Mail Order Orders with Niton online, by phone, by Post or by Fax.

Access to our Mail Order Service will require user registration, The information that you provide must be accurate and complete.

By using our Mail Order Service you are indicating your acceptance to be bound by our Terms and Conditions of Trading.

They form a legal agreement between you and us and can only be amended with our consent.

We reserve the right to change these Terms and Conditions from time to time without prior notice, provided that any such change will not affect any purchases you have made before the change is implemented. Your continued use of our services shall signify your acceptance to be bound by the latest Terms and Conditions.

All orders placed by you are subject to acceptance by us. We reserve the right not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances. We may also close your account for any reason and will not be liable to you or to anyone else in those circumstances.

Acceptance of your order and the formation of a contract between us will take place when we dispatch the products ordered by you to you, unless we have notified you that we do not accept your order or you have cancelled it. By making an offer to purchase, you agree to be bound by our Terms and Conditions of Trading. If you do not accept our Terms you should not place an order. If there is anything you do not understand please feel free to contact us.

Placing An Order

  • Phone Orders - You may place your order by Phone on 01293 549858 9am until 5pm Monday to Friday. Please note that we are closed weekends and Bank Holidays.
  • Fax Orders - You may order by fax by faxing your order to 01293 538062
  • Online Orders - You may place your order online via our website www.niton999.co.uk
  • Post Orders - You may place your order by post by sending your completed order to Niton Equipment Limited, PO Box 999, Crawley, West Sussex, RH10 6YG.
  • In Person - Our Trade Counter facility is open Monday to Friday 9am until 4pm. Please note we are closed on Bank Holidays and Weekends. The Trade Counter is NOT open to the General Public and Official ID is required for entry.

Payments

We accept the following methods of payment:

  • Credit or Debit Card - We accept all major credit and debit cards. Mastercard, Visa, Solo, Maestro and Visa Electron.
  • PayPal - Please select the PayPal option during the checkout procedure and follow the onscreen instructions. Please note that goods will only be dispatched to a verified PayPal address supplied with the PayPal payment with the only exception being an Official Police and Military addresses for restricted items.
  • Cheque - Made Payable to Niton Equipment Limited, cheque with order basis. Please note that all cheques require 7 working days to clear before your order is dispatched. Postal Order - Made Payable to Niton Equipment Limited.
  • Cash - Please send by Registered Post only.
  • Accounts/Purchase Orders - Purchase Orders are accepted by post or fax or email and must quote and official purchase order number.
  • BACS/Wire Transfer - Account and International Customers can pay directly into our account using the following banking details.

Goods must be paid for in full before your order will be dispatched. Please note that from the 1st September 2005 every credit or debit card transaction must be submitted to a full security check. The security check involves matching the data supplied with your order to the data held on file with your bank (as stated on your bank statement) if the data does not match the transaction will be declined.

Product Information

We have taken reasonable steps to display as accurately as possible the colours and other detailing of our products. However, the actual colours and detailing you see onscreen will depend on the equipment you use to view the products. Any information regarding sizing of products is included as a guide only. If you are in any doubt as to the size of any product you require, we recommend that you contact us prior to placing an order.

Age-Restricted Products

If you wish to order a product where a minimum age requirement is indicated, you must confirm that you are of the required age before you will be able to proceed with the order. We reserve the right not to supply any age-restricted product where we reasonably believe that you are below the relevant minimum age. For certain age-restricted products only certain specified payment methods may be allowed.

WaitList Orders

Some products that are currently out of stock are available to order using our PreOrder service. We will advise you if this option is available when you place your order.

PreOrder means you can order a product immediately and we will dispatch it to you if it comes back in to stock within the next 180 days. In order to reserve stock PreOrders will be charged to your debit/credit card or PayPal account, you can cancel your order and request a refund at any point up until dispatch.

WaitList orders are fulfilled in the order that they are received. When new stock arrives, the customers who ordered first will receive their products first. An email will be sent to you when your order has been dispatched to advise you to expect your delivery.

Delivery

We use both Couriers and Royal Mail for all our delivery services.

We continually monitor our delivery services in order to bring you the fastest most efficient service at the most competitive prices; as such our delivery services and prices are subject to change.

If you are placing your first order you must supply your registered card holder address for the delivery, the only exception to this rule is if you can supply a Police or Military address for delivery. Once an order has successfully been delivered to the card holder address subsequent orders can be delivered to an alternative address.

Please Note that It is the responsibility of the Customer to ensure that someone is available at the delivery address to sign for the parcel, if no one is at the address when the delivery arrives a card will be left with details of how to arrange a new delivery or collection.

If you have successfully ordered from Niton before and are not available at your address to sign for your delivery you may nominate a safe place for your parcel to be left at the time of placing your order.

When ordering online please enter this information in the Special Requirements Section in the shopping cart. Please note that this is entirely at your own risk as we can not accept any liability for lost or stolen items, our couriers will not leave a parcel with a neighbour or in a safe place unless instructed to do so in writing by Niton.

Express Guaranteed Delivery

  • If you require a Guaranteed Timed or Saturday Delivery please choose this option during the checkout process.
  • If you do not specify one of our Guaranteed Timed Delivery Services your delivery will be attempted between 8am and 5.30pm Monday to Friday Only.
  • If you are not at the delivery address when the courier attempts your delivery a calling card will be left providing you with contact details and instructions, please respond to this card upon receipt.
  • A signature must be obtained at the delivery address. Deliveries will not be left safe without a signature or with a neighbour unless previously agreed in writing by Niton prior to dispatch.
  • All changes to delivery addresses will be charged a re-direction fee of £10.50. Requests for delivery re-directions will only be authorised by Niton, requests for re-direction must be made in writing to Niton and not via the Courier Company.
  • Niton will not be responsible for extra delivery charges resulting from non-deliveries, if the courier is unable to complete your delivery and goods are returned to Niton the fee for deliveries Returned to Niton is £10.50 (this amount will be deducted from the value of goods returned or charged to your account before goods are re-dispatched).
  • It is the customer´s responsibility to inform Niton of non delivery within 24 hours of receiving your order shipping/order conformation. Our Customer Services Team will be happy to liaise with the couriers on your behalf in order to ensure the successful delivery of your order.

Economy Delivery

This service is available for low value orders (please see our website or contact our Sales Department for order values) and is provided by Royal Mail it is not guaranteed. Royal Mail aim to deliver within 5 working days, if you do not receive your order within 5 working days please contact our Customer Service Department for further information. Please be aware that when using our Economy Delivery Service Royal Mail will not consider an item delayed until 15 working days have passed since the order was dispatched. Once the 15 working days have passed we can enter into the claims procedure with Royal Mail; however please be aware that we can not re-issue goods sent by Royal Mail until the Royal Mail investigation has been completed.

Free Delivery

The Free Delivery Offer applies to Internet Orders only and being placed for delivery to an address in Mainland UK (For a full list of the excluded postcodes, please read above). There is no minimum or maximum order value you simply need to be ordering at least one item from our "Hot Picks" list and you will receive Free Economy Delivery on your entire order.

By selecting this offer you are selecting our economy delivery which is not time guaranteed and you may have to allow 5 working days for delivery. Niton reserves the right to select which carrier and service is used on an order by order basis. If you do require a time guaranteed delivery you will need to select one of our chargeable Next Day Delivery options.

Certain Highland & Island postcodes have had to be excluded and will NOT qualify for this offer:

Hotpick Backorders: Please note that orders qualifying for free delivery will only be shipped complete, therefore If any item on your order is out of stock we will hold the whole order and only ship once all stock is available. If you need your available items urgently then please select any of the appropriate paid delivery methods.

Hotpick Returns: Please note that if you are returning an item for exchange this constitutes placing a new order. As such if the replacement item does not feature in our "Hot Picks" you will be charged postage and packing on the exchange at our standard rate.

Returns And Order Cancellation

You also have a statutory right to cancel your purchase. If you wish to cancel you must tell us in writing, by telephone, fax or email sales @ niton999.co.uk upon receipt in order to obtain a Returns Number. You should keep evidence of having given your cancellation notice, such as a certificate of posting. You must take reasonable care of the product and you must return the product to us (at your own risk and cost) within 14 days of dispatch (7 days for Sale or Clearance Items). All goods remain your property until they are received by our Returns Department.

The product must be returned unused (except to the extent use was reasonably necessary to examine the product) and with the original packaging and Sales Receipt with the reverse section completed with the Returns Information. We will refund the purchase price of the product less the delivery charges.

The following products are excluded from this legal right to cancel: audio/video recordings, DVDs or computer software that you have taken out of the sealed packaging in which they were delivered to you; products made or customised to your own specification, Books and any other products that by reason of their nature cannot be returned such as earpieces for hygiene reasons.

Trade Counter Returns

Items purchased from our Trade Counter Facility must be returned within 14 days of purchase together with the Sales Receipt and are subject to a 10% re-stocking fee. Items will not be accepted without proof of purchase.

Faulty Or Damaged Products

Faulty Upon Receipt

Upon receipt of your order if you have a faulty or damaged product please Contact our Customer Service representatives immediately to report the problem and obtain instructions on how to proceed. Please ensure that you retain all packaging materials.

We will exchange any item or refund the purchase price together with the return postage costs (providing a receipt for postage is included with the return) for any product which is delivered in a damaged or faulty condition.

Please note that we do not refund the cost of Royal Mail Special Delivery or Courier Charges, items under £50 in value being retuned as faulty must be returned via Royal Mail Recorded Delivery, items between £50 and £150 in value must be returned via Royal Mail Insured Parcels.

If you are returning a faulty item with a value in excess of £150 please contact our Sales Department who will confirm how the item should be returned.

Faulty Within 6 Months Of Purchase

We will warranty any product which develops a fault within a period of 6 months from delivery (other than due to normal wear and tear, failure to follow instructions or misuse) Niton will replace the product with the same, or a similar product (subject to stock availability).

We will cover the return postage charges for any item which develops a fault within 6 months of date of purchase providing it is returned with a postage receipt and is returned using one of the above approved postage methods. Please note that we can not refund postage costs without a valid postage receipt.

Faulty In Excess Of 6 Months Of Purchase

Once six months from date of purchase have passed you will be referred to the Manufacturers warranty, your return will be accepted for inspection only and at your own risk and cost we do not guarantee to offer any kind of refund or replacement.

Upon receipt of your return we will contact the manufacturer and take their advise as to how to proceed. Once we have a response from the manufacturer we will contact you, please note that any decision or offer made at this stage is final.

In all circumstances some products may need to be referred to the manufacturer, therefore you must allow 30 days from our receipt of your product for your refund to be processed or a replacement product to be dispatched.

We reserve the right to refuse to issue a refund/replacement product and to recover the cost of the return delivery from you in the event that the product is found to have suffered damage after delivery or has been misused or used other than in accordance with the instructions or if the problem is due to normal wear and tear.

Nothing in this section or elsewhere in these Terms and Conditions or in our returns policy affects your statutory legal rights.

Security And Data Protection

We are committed to protecting your privacy and the security of any information given to us in order for us to process your order. We will not sell or pass your details to third party organizations except for the purpose or processing your order.

Our Liability

We will not be liable to you where performance of any of our obligations is prevented or restricted by any circumstance or cause beyond our reasonable control.

You are responsible for the use you make of the products you order. To the extent not prohibited by law, we accept no liability for any loss which is not reasonably foreseeable or for any business loss (which includes loss of profits, contracts, goodwill, opportunity and other similar losses).

We accept liability for death or personal injury caused by our negligence and responsibility for fraudulent misrepresentation and any other liability that cannot, under English law, be excluded.

Any formal legal notices should be sent to us at the address at the end of these Terms and Conditions by post or by email and confirmed by post.

Failure by us to enforce a right does not result in waiver of such right. You may not assign or transfer your rights under these Terms and Conditions.

If any part of these Terms and Conditions is found to be unenforceable as a matter of law, all other parts of these Terms and Conditions shall be unaffected and shall remain in force.

No term of any contract subject to these Terms and Conditions shall be enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person not a party to such contract.

You and we agree that English law applies to these Terms and Conditions and that any dispute between us arising out of or in connection with these Terms and Conditions will only be dealt with by the English courts, unless you are resident in another part of the United Kingdom, in which case the applicable law of that part of the United Kingdom will apply and any dispute will be brought before the courts there. We are required by law to inform you that purchases can be concluded in English only and that no public filing requirements apply.
